The Department of Correctional Services has confirmed that jailed ANC Nelson Mandela Bay councillor, Andile Lungisa, has opted to remain behind bars.
This is in spite of Grahamstown High Court judge, Motilal Rugunanan, granting him bail of R10 000 on Friday, pending the finalisation of his appeal application to the Constitutional Court.
Lungisa’s lawyer, Alwyn Griebenouw, told Algoa FM News that he would be consulting with his client on Monday for further instructions.
This would include Lungisa’s response to a demand from judges of the Supreme Court of Appeal that he publicly apologises for criticising their decision to dismiss his application for leave to appeal his two-year sentence for assault.
The ANC councillor, who is also facing calls by his own party to step aside, was jailed for assaulting DA councillor, Rano Kayser, with a glass jug during a brawl in Council in 2016.
Correctional Services spokesperson, Singabhako Nxumalo, said; “Mr Lungisa opted to continue with his rehabilitation programmes, as a result, he will not be placed out.”
