The North Gauteng High Court has ruled that Jacob Zuma's medical parole is unlawful and that he has to return to jail.
The court ordered on Wednesday that the time the former President was out on medical parole should NOT be counted for the fulfillment of his 15-month jail sentence for contempt of court.
The court further ruled that the decision taken by former National Commissioner of Correctional Services Arthur Fraser to place Zuma on medical on the 5th of September of this year was unlawful and should be set aside.
The court directed that Zuma be returned to the custody of the Department of Correctional Services to serve out the remainder of his sentence of imprisonment.
Judge Keoagile Elias Matojane also ordered that Zuma and Fraser pay the costs of the matter.
The application for the review of the parole decision was made by the DA, Helen Suzman Foundation, and Afriforum.
Afriforum's Ernst Roets said the court further ruled that the period that Zuma was out of jail on medical parole will not be deducted from his 15-month prison sentence.
In its reaction, the Jacob Zuma Foundation confirmed that the former President had filed an application for leave to appeal the North Gauteng High Court judgement.
The Foundation said it believes the judgement is wrong and that there are strong prospects of a higher court coming to a different conclusion.
The application was filed on Wednesday afternoon.
