The State Capture Commission said it lodged an urgent application in the Constitutional Court for an order declaring the walkout by the former president, Jacob Zuma, without the Chairperson’s permission, was unlawful.
Commission Chairperson, Deputy Chief Justice Raymond Zondo, said summonses were served on the former President last week and early this week to appear before the Commission between 18 and 22 January and 15 to 19 February.
Zuma led a walkout of his team from the Commission on 19 November after Judge Zondo dismissed his application to recuse himself.
In a statement on Friday, Judge Zondo said that the application to the Constitutional Court order seeks to compel Zuma “to account for his exercise of public power as President of the country” and in regard to the “matters being investigated by the Commission.”
Zondo also wants the Constitutional Court to declare Zuma’s “failure to appear before the Commission on 20 November 2020 was unlawful” and that he should be compelled to
comply with the new summonses that have been issued against him.
The Deputy Chief Justice also wants a cost order made against the former President.
