Yet another urgent application to be lodged against Public Protector


An urgent application lodged by President Cyril Ramaphosa to have the implementation of remedial action ordered by Public Protector Busisiwe Mkhwebane against him suspended will be heard in the North Gauteng High Court on Tuesday.

Earlier this month Mkhwebane found that Ramaphosa had deliberately misled parliament about a R500,000 donation from corruption accused Gavin Watson, CEO of Bosasa.

On Monday Public Enterprises Minister Pravin Gordhan won the first round in his court battle with Mkhwebane.

This, after the Pretoria High Court, granted him an interdict suspending the latter from enforcing any remedial action against him with respect to the SARS rogue unit findings.

Mkwebane's remedial action, which called on the President, Parliament, the Police and National Prosecuting Authority to act against Gordhan, was suspended pending the outcome of a review application which comes before court at a later stage.

Judge Sulet Potterill said that the Public Protector's remedial action was vague and that Gordhan would suffer irreparable harm if the interdict was not granted.

The Public Protector expressed her dissapointment with the ruling and said she would appeal.
