Deputy Chief Justice, Raymond Zondo, said that the late Bosasa boss, Gavin Watson was due to be served with a notice to provide an affidavit to the State Capture Commission.
Zondo said on Wednesday that he had issued the directive as per commission rules, but this had not been served when Watson died on Monday.
He said the directive did not require him to appear before the Commission but to submit an affidavit following damning allegations made by former Bosasa COO, Angelo Agrizzi.
Watson was killed in a single-car accident outside the O.R. Tambo International Airport in Johannesburg.
The 73-year-old CEO of Bosasa, now known as African Global Operations, was alone in the vehicle when it crashed into a bridge pillar.
