The Pretoria High Court has granted the lobby group Outa leave to appeal a ruling that Gauteng e-tolls can go ahead.
Judge Louis Vorster, who made the original order, said he would provide written reasons if requested.
Outa argued earlier that Vorster had misinterpreted a section of the SA National Roads Agency Limited Act on public consultation to reach his ruling that e-tolling could proceed.
The matter will now revert to the Supreme Court of Appeal in Bloemfontein.
Outa's Wayne Duvenage says "there's no doubting the fact that society has overwhelmingly rejected e-tolling. It is too expensive, it is almost unworkable and it is an irrational decision," he said.
"It is one that was taken without meaningful and proper consultation and we believe that today's (Friday) ruling will ensure that that is taken care of, heard clearly and dealt with in the Constitutional realms of this matter in the Supreme Court of Appeal."
