The death toll in Monday morning's accident on the N1 near Verkeerdevlei towards Winburg has risen to 13.
Police spokesperson Stephen Thakeng says the truck driver involved in the head-on collision with a taxi has also been arrested.
The 47-year-old man will be charged with culpable homicide.
Thakeng says it is alleged that the truck driver lost control in the early hours of the morning and landed in front of the oncoming minibus taxi on the N1 road next to Candy Farm.
He says seven men, a baby boy and three girls died on the scene and more bodies were discovered then the taxi was tipped over by officials.
Three children aged between 10 and 12 were admitted to the Pelonomi Trauma hospital with serious injuries.
He says the taxi was travelling from Johannesburg to Sterkspruit in the Eastern Cape.
