Justice Minister Michael Masutha says he will consider a petition by an NGO opposing Oscar Pistorius's release together with a legal opinion.
Minister Masutha said he will announce his decision before Friday.
Ministry spokesperson, Mthunzi Mhaga, says the Minister, in considering the petition by the lobby group, Progressive Women's Movement of South Africa, will also satisfy himself that the decision by the parole board and the process that preceded the decision to place Pistorius under correctional supervision complied with the law.
Mhaga says Minister Masutha is seeking a legal opinion to see if he is empowered to intervene if necessary.
The former Paralympic athlete is expected to be released into correctional supervision on Friday after serving 10 months of a five year sentence for the shooting death of his girlfriend Reeva Steenkamp, who would have turned 32 today.
