KZN Health Dept must sell furniture to settle legal dispute

The Kwazulu Natal Health Department has been instructed to auction furniture to pay the Rural Allowance of a doctor and to cover the cost of legal action brought by the South African Medical Association.

SAMA said in a statement on Friday that it approached the CCCMA for the certification of an Arbitration Award granted by the Bargaining Council after the Provincial Department failed to pay the practitioner a Rural Allowance of close to R250 000.

"Rural allowance is payable to state employees working in designated rural health facilities and is aimed at retaining the skills of these professionals at their respective facilities," said SAMA chairperson, Dr Anglique Coetzee.

She said after the KZN Health Department failed to honour the payment as per the arbitration award, SAMA followed due processes through the office of the Sheriff, wherein the Department's furniture was removed to cover the costs owed to the Doctor.

"The Department of Health's application to stay the sale in execution was dismissed by the Labour Court on Thursday, with costs, and the sheriff has already taken possession of items that will be auctioned today (17 Sept) to cover the Rural Allowance as well as the court costs."

"To first off not pay someone who is entitled to this allowance is unprofessional, unethical, and illegal. That's exactly why we brought the matter before the CCMA. That the KZN Department of Health then ignored the ruling by the CCMA is outrageous in the extreme," Dr Coetzee said.
