The Equality Court sitting in Johannesburg has ruled in favour of the EFF stating that their song "Kill/Kiss the Boer" does not incite harm nor does it amount to hate speech.
Afriforum lodged a complaint two years ago stating that EFF supporters sang the controversial song outside the Senekal Magistrates Court in the Free State.
Protesters were gathered outside the court where two suspects appeared in connection with the murder of farm manager Brendin Horner.
Both the accused have since been acquitted of the crime after no DNA could link them to the murder.
During the trial, Afriforum's head of Policy and Action, Ernst Roets, who also wrote the book Kill the Boer, offered his testimony as an expert witness during the trial.
Judge Edwin Molahleli said during Judgement that Roets could not be considered an expert witness as he had a vested interest in the outcome.
He also ordered Afriforum to pay the costs.
The Civil Rights Organisation will appeal the ruling.
