The Umkhonto WeSizwe party's application for leave to appeal is expected to be heard on the 1st of November after the Western Cape High Court barred MK party parliamentary leader, John Hlophe from sitting on the Judicial Service Commission interview panel set for next week.
As an MP, Hlophe was designated by the National Assembly as one of the six members to sit on the JSC.
But the DA and other civil society organisations rejected the move due to his impeachment in February this year.
Parliament impeached the former Western Cape Judge President after the JSC found him guilty of gross misconduct.
The charge stemmed from his attempt in 2008 to influence two Constitutional Court judges to rule in favour of former president Jacob Zuma in his arms deal corruption case.
MK spokesperson, Nhlamulo Ndhlela said last week's ruling was riddled with glaring legal errors, misdirection, and a violation of both Hlophe and the party’s constitutional rights.
