Gerald Majola has been fired as CEO of Cricket South Africa.
Cricket South Africa has just released the finding on the sanction of Majola, under the Independent Chairmanship of Advocate Karel Tip SC, which confirms his dismissal.
Majola was earlier found guilty on several charges but primarily of the non-disclosure and receipt of bonuses from the 2009 Indian Premier League tournament and the ICC Champions' league and the misuse of his travel allowance.
He was invited to attend both the findings and the sanction, but chose not to do so.
The disciplinary hearing of Cricket South Africa (CSA) CEO, Gerald Majola, under the Independent Chairmanship of Advocate Karel Tip SC was scheduled to hear testimony on various days in October 2012.
At the commencement of the proceedings, Mr Majola's legal team argued a special plea which was dismissed which was the same special plea previously argued before and dismissed by Advocate Myburgh SC in the advisory hearing.
Then again on October 9, 2012, Mr. Majola's legal team served an application to adjourn the disciplinary proceedings pending an urgent application to the Labour Court for the review and setting aside amongst others, the decisions of CSA's Board to institute these disciplinary proceedings and certain other decisions on which the Board's decisions are based.
The application for an adjournment was dismissed on October 10, 2012 and the response from Mr. Majola and his legal team was that they would be withdrawing from the disciplinary hearing. Before they left they were informed that the hearing would proceed in their absence. In addition Advocate Tip SC made it clear to Mr Majola and his legal team that, if they left, he would have to reach his findings on the charges without the benefit of cross-examination by his counsel of CSA's witnesses, without the presentation of his version, and without hearing evidence by him and/or on his behalf. Mr Majola and his legal team indicated that they understood the consequences of their decision to withdraw but nevertheless departed.
The hearing proceeded and the chairman made his finding on the merits and found Mr Majola guilty of all nine charges.
This was followed by a hearing wherein submissions on an appropriate sanction were presented and despite an invitation to attend, Mr Majola and his legal team did not arrive.
On 19 October 2012, the disciplinary chairman issued his findings on sanction which CSA will implement with immediate effect. The sanction handed down by Advocate Tip SC was that Mr Majola is dismissed from his service with CSA with immediate effect.
The Disciplinary Hearing was an internal matter but it is a matter of broad public interest and, therefore, the findings made by Advocate Tip SC and the ruling on sanction is set out in full detail in the attached finding for public consumption.
