Public Enterprises Minister, Pravin Gordhan, has lost his hate speech application against EFF leader Julius Malema in the Equality Court.
Gordhan was seeking an order that would compel Malema to apologize, pay the costs and donate 150-thousand rand to a charity.
However, Equality Court judge Roland Sutherland said while Malema's reference to Gordhan as a dog of white capital was indeed hateful, the Minister had failed to bring his grievance within the compass of the Equality Act.
This is the second case involving hate speech that the EFF has won at the Equality Court.
Two weeks ago, the court ruled against the SA National Editors Forum which had brought a case accusing Malema and his party members of harassing journalists on social media platforms.
