Court rules in favour of learner who wants her results published in the media

A pupil who matriculated from an independent Christian school in Pretoria last year might just get to see her matric results published in her local newspaper.

This, after the 18-year-old Anlé Spies, together with Afriforum and Maroela Media, brought an application to have the results published following last week's surprise announcement by the Department of Basic Education to not publish the results due to the Protection of Private Information Act (POPIA).

Afriforum has welcomed the court ruling by Judge Millar in the North Gauteng High Court that granted the organisation’s order unchanged.

The organisation is confident that the matric results can be published on Thursday 20 January and that former matriculants will be able to get their results in the newspapers and on media platforms.

Spies, who brought the application, is the daughter of former Member of Parliament (MP) Willie Spies who has joined Afriforum last year as their full-time legal advisor.

Afriforum's manager for Education Rights Natasha Venter said it is in the public's interest to have the results shared on public platforms.

South Africans seem to be divided on this issue as many parents welcomed the decision by the Department of Education.

It is not yet clear if learners would have to give their consent.

The Department of Education said in a statement they "noted" the ruling and will abide by it.
