Charges have been dropped against one of two men accused of beating a Muslim man to death in Magaliesburg in August.
National Prosecuting Authority spokesperson, Phindile Louw, said the case against 33-year-old Zayne Van Tonder was withdrawn because of "lack of evidence linking him to the incident".
However, the case against his co-accused, 28-year-old Roedolf Viviers, will continue in January.
He's accused of beating Muhammad Fayaaz Kazi to death following an altercation in a fast food outlet allegedly over the length of his beard.
