Two councillors from the Nelson Mandela Bay Metro wants to oust the newly elected Mayor Gary van Niekerk in a vote of no confidence.
A motion was filed on Tuesday by councillor Tukela Zumani from the DOP party and Luxolo Namete from the UDM.
They accuse Mayor van Niekerk of deliberately misleading the council with regard to the name change of his party from the Northern Alliance to the National Alliance,
Van Niekerk told Algoa FM News on Wednesday that this motion will be declared null and void.
He said he received calls from DOP's national and provincial structures who informed him that Zumani was an expelled member of the party and therefore had no mandate to file such a motion.
The Mayor says a letter will be written to the Speaker on Wednesday and the motion will be declared null and void.
Meanwhile, DOP issued a statement on Tuesday to distance themselves from the motion.
The party has written to the Speaker, Eugene Johnson to declare the motion null and void.
The party says Mr Zumani is currently challenging his expulsion from the party at the Gqeberha High Court.
The matter will be heard on the 17th of August.
