The Gqeberha High Court on Tuesday ruled that the appointment of the MBDA CEO Anele Qaba be set aside with costs.
The Democratic Alliance described the ruling as a victory for the residents of Nelson Mandela Bay
Opposition leader Retief Odendaal said his appointment was a blatant attempt at state capture of the municipality
He said the ruling vindicated the DA, who acted as the whistleblower.
Meanwhile, the MBDA Board said they would study the judgement and consider all available options.
Spokesperson Luvuyo Bangazi said they would give no further comment until then.
In a statement issued by the DA, Odendaal said Qaba is a close friend of NMB Executive Mayor, Gary van Niekerk, who appointed him as CEO a mere two days after being elected mayor.
The main opposition at the time wrote to the National Treasury to request an urgent intervention.
