Three former Selborne College learners facing eight counts of assault want all charges against them dropped in the East London Magistrate's Court.
This was revealed by the defence attorneys of Liyema Badli, Liyabona Masebe and Alizwa Matwa, who matriculated from the semi-private school last year.
Only Matwa was not present in court as his private lawyer submitted a doctor's note.
The trio, who are now university students, were released on warning in November last year, after allegedly beating seven of their schoolmates with cricket bats.
Several of the victims who were Grade 8 learners at the time, ended up in hospital due to the severity of their injuries.
Two of the three young men were first-team captains in hockey and rugby, while also maintaining prefect positions in the school.
They were released on warning last year to finish their matric exams, for which Badli got four distinctions.
State Prosecutor, Lerato Nqobile, says despite their prerogative to submit representations, the state will continue with their investigations.
The state alleges on the 20th of November, Badli, Matwi and Masebe woke up the group of seven boys and took them to one of their hostel rooms.
Upon arrival, the boys were allegedly assaulted with cricket bats resulting in three of them being rushed to Life St Dominic's Hospital where they spent days recovering.
Algoa FM News approached one of the accused for comment, to which a woman who was with him declined on his behalf.
The trio remain out on warning and will be back in court on the 30th of June when their lawyer will submit representations asking the state to drop the charges against them.
