The Nelson Mandela Bay Municipality (NMBM) says it is committed to its annual Summer Season Programme.
This is despite the Metro being embroiled in a civil matter over the festive programme tender.
NMBM and the local businessman, Darren Munger, of Lumigenix CC/Soul Good are now in talks to try and reach an out-of-court settlement.
Mungur wants the Gqeberha High Court to review and set aside what he calls the irregular awarding of the multi-million rand tender to Sime and Mzweido Trading CC for the Summer Season programme.
According to court papers seen by Algoa FM News, the businessman has accused Metro officials of disassembling his tender bid pack and removing the BBBEE-score card to purposefully disqualify Soul Good from the bid evaluation and adjudication process.
Mungur says he is of the view that the Metro's decision was induced by fraud and deliberate error.
The Metro, which filed opposing papers in court, has denied any wrongdoing.
In its replying affidavit, the Municipality maintains that Soul Good failed to attach a BBBEE certificate which resulted in Sime and Mzweido Tradiding CC scoring more points and subsequently winning the tender bid.
Meanwhile, Algoa FM News approached both Mungur and the Metro but they both applied the sub judice rule and declined to comment on the matter.
However, Metro spokesperson, Sithembiso Soyaya said the Municipality has committed to the opening of the season and more details will be communicated in due course.
Last year, several municipal events were cancelled not only due to the Covid-19 lockdown but also due to challenges with Munger.
At the time, the then Mayor Eugene Johnson said the three-year contract for the Summer Season had ended and had to be advertised to recruit a new service provider.
