Bay father sentenced on child porn charges


A Gqeberha father has been sentenced to ten years imprisonment for sexually exploiting his twin daughters, who were eight years old at the time.

The trial against the 52-year-old man, who cannot be named to protect his children's identity was brought to finalisation on Tuesday, nine years after the offences had taken place.

The man took naked pictures of his daughters and then distributed them online.

He was also found in possession of child and baby pornography that was stored on his laptop.

During sentencing, Magistrate Shaida Du Plessis-Wajiid said the man took advantage of his children's vulnerability, who trusted him as their Father.

She also said that he did not show any remorse and that any offences perpetrated against children were viewed in a serious light.

"Child pornography charges are universally condemned. It strikes at the dignity of children."

According to Du Plessis-Wajiid, there were no substantial and compelling circumstances for the court to deviate from the minimum prescribed sentences.

"A sentence of direct imprisonment is the only suitable sentence under the circumstances," she added.

On the first four charges pertaining to the law on the contravention of the Films and Publications Act, the man was sentenced to two years on each count (possession and dissemination of child pornography).

For the two counts of sexual exploitation, he was sentenced to 10 years on each count.

Du Plessis-Wajiid ruled that the sentences on the first five counts should run concurrently with the 10-year sentence meted down on count six.

This means that the man will spend an effective ten years in prison.

Whilst out on bail for the six charges the man has now been sentenced for, he was caught for the possession of child pornography.

On this one charge, Du Plessis-Wajiid sentenced him to three years in prison, which was wholly suspended for five years.

She ruled that this sentence should run concurrently with the others.
