Advocate Gerrie Nel appeared in the Kuilsrivier Magistrates Court in Cape Town on Monday for the private prosecution of convicted wife-beater Jaco Swart.
Afriforum's Private Prosecution Unit is representing Warrant Officer Sonja Albertyn, who was allegedly assaulted by the 39-year-old.
The accused became one of the "most wanted" men in the country when a video of him viciously assaulting his estranged wife went viral on social media.
At the time, the court would not allow the video to be used in aggravation of sentences as the defence questioned its authenticity.
As a result, Swart was fined just R20 000 for the assault and received a suspended sentence.
A spokesperson for the Unit, Barry Bateman, says police have previously tried to serve a summons on Swart in connection with a fraud matter registered in Pretoria.
He says they could not locate him as it is believed he had fled to the United Kingdom (UK), where he is reportedly working illegally.
The court heard on Monday that Swart used a friend's passport to leave South Africa through the Lebombo Border Post before making his way to the UK.
This was according to the testimony of Warrant Officer Riaan Booysen, who was called to the stand by Nel.
W/O Booysen told the court that he had consulted with the National Prosecuting Authority (NPA) about the possible extradition of Swart, but he was told that it was too difficult to do because it amounted to "a lot of paperwork".
Nel argued that ensuring extradition was not outside the capability of the state and referred to the recent Thabo Bester matter which saw senior government officials and politicians travel abroad to bring that accused back to the country.
The case was postponed to the 21st of August, for judgment.
