The National Prosecuting Authority (NPA) says they will no longer charge the accused in the Thabo Bester case with murder after further evidence was presented by the Investigating team.
A spokesperson for the NPA in the Free State Phaladi Shuping says prosecutors can only bring charges based on the evidence presented in court.
An autopsy report of the man who was found dead in Bester's cell registered the victim's death as unnatural and the investigation is still open.
Shuping says, therefore, there is insufficient evidence to pursue a charge of murder, pending further investigation.
The body that was found burnt beyond recognition inside Thabo Bester's cell at the Mangaung Correctional Centre in Bloemfontein was only identified last month, almost a year after Bester's escape.
The victim, identified as Katlego Mpholo Bereng, was found with blunt-force trauma to his head.
The Autopsy also revealed that his body was set alight after he was already dead.
A memorial service for Bereng was held on Thursday.
The girlfriend of the so-called Facebook rapist and murderer, Dr Nandipha Magudumana and her co-accused appeared in court on Wednesday where their bail application was postponed to next week.
The accused are currently facing serious charges relating to corruption, fraud, defeating the ends of justice, escaping from custody, assisting an inmate to escape, and violation of a body, amongst others.
