The Supreme Court of Appeals has reserved judgement on former Hawks head, Berning Ntlemeza's, appeal to carry out his duties while the appeals process against his appointment continues.
Ntlemeza's representative, as well as the Helen Suzman Foundation (HSF) and Freedom Under Law (FUL), made submissions before the full bench of the court on Friday.
Ntlemeza's lawyer, Nceba Dukada, argued that his client's reputation was being tarnished, while he was not being allowed to carry out his duties, after the Pretoria High Court found his appointment to be unlawful and irrational.
Dukana also said reasons weren't stated as to why he should not hold office while the matter is pending.
The Helen Suzman Foundation and Freedom Under Law earlier asked the court to remove Ntlemeza "in terms of Section 18 of the Superior Courts Act, from fulfilling any duties as head of the Directorate for Priority Crime Investigation (DPCI) pending any appeals."
The respondents also argued that Ntlemeza must pay costs in his own capacity.
