Trade Union Solidarity says it will be serving court papers before the end of the week to overturn the suspension of Schweizer-Reneke teacher Elana Barkhuizen.
It wants her suspension lifted immediately.
Solidarity says it will also approach the SA Human Rights Commission to investigate the conduct of North West Education MEC, Sello Lehari, as well as the actions of several political parties.
Lehari suspended Barkhuizen amid a social media storm over a photograph that she took showing a group of black Grade R children sitting at a separate table from a group of white learners on the first day of the new school year.
Subsequent photos published on social media showed black and white learners in the same class sitting around the same table.
Speaking at a media briefing on Tuesday, an emotional Barkhuizen said she did not separate the children and also denied being racist.
She said she was a good teacher and would fight every inch of the way to clear her name and ensure that something like this never happens to another teacher in this country again.
