A man, who suffered brain damage at the Charlotte Maxeke Academic Hospital in Johannesburg in 2005, was awarded R5 million plus costs in the High Court in Johannesburg.
The Democratic Alliance says the R5 million medical negligence payment plus costs was awarded to 30-year old Nicholaas van Niekerk.
DA spokesperson, Jack Bloom says the department paid out more than R44 million this year in medical negligence claims.
Van Niekerk's compensation was to cover loss of earnings, future medical expenses and general damages for pain and suffering.
However, Gauteng health department spokesperson, Simon Zwane could not confirm the payment.
