The South African Police Service said it would be investigating the alleged contravention of the Disaster Management Act by some mourners at the home of the late struggle stalwart, Andrew Mlangeni.
Police spokesperson, Brigadier Vishnu Naidoo, said that it had come to the attention of the Joint Operational and Intelligence Structure that many people had made calls, via social media, that the mourners who visited the Mlangeni home on Tuesday afternoon, be arrested.
“The Regulations in terms of the Disaster Management Act 57 of 2002 makes provision for the dispersing of crowds who gather illegally and to hold accountable a person or persons who convenes or organises illegal gatherings,” he said.
Naidoo said a case of contravention of Section 48 (1) (a) of the Disaster Management Act 57 of 2002 will be opened for investigation.
“On completion of the investigation the docket will be submitted to the Directorate for Public Prosecution for a decision,” he said.
Mlangeni, the last surviving Rivonia Trialist, died this week in 1 Military Hospital in Pretoria at the age of 95.
He was laid to rest on Wednesday.
