Charges were withdrawn on Friday against a man accused of being involved in the death of young Taegrin Morris, who died when he was dragged along the road during a car hijacking on the East Rand.
The Magistrate ordered that as the State had stated that they withdrew charges against the accused, the accused would be released from custody with immediate effect.
The prosecutor did not give reasons for the withdrawal of charges against Thamsanqa Twala in a brief session in the Boksburg Magistrate's Court.
Four-year-old Morris died when his parents' car was hijacked in Reiger Park in July.
Three men approached the car and ordered the family out.
The boy was caught in his seat-belt and was dragged several kilometres along the road as the hijackers drove off.
