Mkhwebane withdraws appeal against Gordhan ruling


Public Protector Busisiwe Mkhwebane has withdrawn her appeal against a July ruling in the Pretoria High Court which interdicted the implementation of remedial action against Public Enterprises Minister Pravin Gordhan.

The order by Judge Sulet Potteril had granted Gordhan stayed the implementation of remedial action contained in the Public Protector's report on the so-called rogue unit in the SA Revenue Service when he was still SARS commissioner.

Gordhan is seeking a review of Mkwebane's findings against him.

Following Potteril's order, Mkhwebane accused Potterill of overreaching in her judgment, which had termed the former's remedial actions as "vague, contradictory and nonsensical".

In the notice of withdrawal, seen by African News Agency (ANA), the Public Protector states: "...the first and second applicants (Public Protector and Busisiwe Mkhwebane, respectively) hereby withdraw their application for leave to appeal directly this Honourable Court against the whole of the order and judgement granted by Her Ladyship, Potterill J, of the Gauteng division of the High Court on 29 July 2019..."
