The Johannesburg Labour Court has also overturned the suspension of SA Revenue Services deputy commissioner, Ivan Pillay.
Judge Annelie Basson ruled on Thursday that Pillay's suspension was unlawful and constituted a breach of contract.
Pillay and strategic planner Peter Richer were suspended in the wake of revelations about a rogue unit that had been operating with the SA Revenue Service.
On Sunday, City Press reported that Pillay had commissioned a report on the tax implications of the extensions to president Jacob Zuma's Nkandla homestead.
Last Friday the Mail & Guardian reported that another factor that led to Pillay's suspension was his refusal to let a consignment of ANC t-shirts, imported from China, to be released by customs without duty being paid.
