The Judicial Services Commission has called on President Cyril Ramaphosa to suspend two judges following complaints against them investigated by the Judicial Conduct Committee.
The JSC said it had considered the reports of the JCC relating to the complaints against Judges Tshifhiwa Maumela and Nomonde Mngqibisa-Thusi of the Gauteng Division of the High Court for their failure to deliver numerous reserved judgments.
In a statement on Friday, the Judicial Service Commission said it decided that “the failure to deliver the reserved judgments, if established, will prima facie indicate incapacity, gross incompetence or gross misconduct on the part of the Judges.”
This is after taking into account the extent of the delay and the prejudice suffered by the parties in those legal matters.
The Judicial Service Commission said it would request that the Chief Justice, Raymond Zondo, appoint a Judicial Conduct Tribunal to consider the complaints against the two, one of whom is the presiding officer in the much-publicised Senzo Meyiwa murder trial.
