IEC chairwoman Pansy Tlakula has conceded in her affidavit to the Electoral Court sitting in the High Court in Johannesburg that she acted unlawfully.
David Unterhalter SC, for various political parties, says she's acknowledged that she acted in an unlawful manner.
He said Tlakula knew the law, but still broke it and that in his opinion that is a very serious misconduct.
The court is holding an investigation into her conduct after an application by several opposition parties to have her resign as IEC Chair ahead of the May 7 elections.
The application follows a forensic investigation by the National Treasury on the procurement of the Electoral Commission of South Africa's Riverside Office Park building in Centurion, Pretoria.
