The Pretoria High Court will hear two applications next week against former Bosasa COO, Angelo Aggrizzi on his fitness to stand trial.
The National Prosecuting Authority says the matter has been set down for six days, starting next Tuesday.
Sindisiwe Seboka of the NPA's investigative directorate, says the two inquiries are in terms of section 67 (2) b and section 34 2A of the Criminal Procedure Act.
“The first application in terms of section 67 (2) b Criminal Procedure Act (CPA) states that ‘’if an accused satisfies the court that his failure was not due to a fault on his part, the provisional cancellation of the bail and the provisional forfeiture of the bail money shall lapse,’’ she said.
Seboka said the second application is in terms of section 342A of the CPA which relates to unreasonable delay of a matter which “could cause substantial prejudice to the prosecution, the accused or his or her legal adviser, as well as the State or a witness.’’
She said Agrizzi is charged with fraud and corruption in connection with tenders between the Department of Correctional Services and Bosasa in the value of R1.8 billion, issued between 2004 and 2007.
“The determination of the inquiry will have a bearing on his case in Palm Ridge Specialised Commercial Crimes Court.
