EFF wins court battle with Parliament


 The EFF has has been granted an urgent court interdict preventing sanctions from being imposed on the party's MPs by Parliament.

Judge Dennis Davis ruled in their favour in the Western Cape High Court - after the party acted on its vow to go to the courts to fight the suspensions.

The suspensions stemmed from a chaotic question and answer National Assembly session in August - in which President Jacob Zuma was heckled by EFF members for what they said was unsatisfactory answers to the Nkandla saga.

Parliament says it has noted the judgement of the Western Cape High Court today which, as an interim measure, requires Parliament to pay with immediate effect, the salaries and allowances to 20 members of the Economic Freedom Fighters who were suspended.

It says in a statement that as the legislative branch of the state, Parliament has always upheld the Constitution and the rule of law, and it will comply with the order.

Parliament says, however, that it is important to note that the order by the High Court delivered today is an interim one.

Judge Dennis Davis, who presided, indicated in his judgement that another court needed to deliberate on the merits of the EFF's application.
