Department of Justice to oppose latest Dewani application


 The Department of Justice says it will oppose the latest court application by UK honeymoon murder accused, Shrien Dewani.

Spokesperson, advocate Mthunzi Mhaga, says Dewani's legal team lodged an application with the court after the South African government submitted an authenticated copy of its undertaking in compliance with direction of the British High Court.

The High Court had ruled that Dewani should come to South Africa to stand trial but that he should be returned if he's found not fit to stand trial.

Mhaga says Dewani's lawyers have asked the court not to accept the government's undertaking, alternatively for the court to certify the two legal questions relating to his mental fitness to stand trial as an accused in order for them to approach the UK Supreme Court.

"The matter will be argued orally on Monday the 3rd of March. We are confident that the court will dismiss his application and even if he goes to the European court of Human rights in France he will still lose" he said
