Defence claims Ballan an habitual drug user



The second bail application assault-accused Brent Cunningham continued in the PE magistrate's court on Friday.

Twenty one year old Cunningham is accused of assaulting former girlfriend Shireen Ballan and two other people in December.

He's been in custody at St Albans prison for almost five months.

Cunningham's father Malcom was also at court on Friday supporting his son.

Cunningham's lawyer, Danie Gouws reiterated that Ballan is a habitual drug user and is a lying witness.

He further added that she changes her story and is a person of low character.

Gouws called witness attornery Louise Louwrens who testified that Ballan had contacted her for help because she had been worried after Cunningham's first bail application was denied.

State Prosecutor, Benedict Wilson argued that it was possible that someone else could have sent the message.

Wilson added that  the only new fact in the case was Cunningham's injuries following the assault and that there is still a history of violence.

Magistrate Gavin Juicy will hand down judgement on Wednesday.
