The State has filed its appeal against paralympian Oscar Pistorius's conviction and sentence for the shooting death of his girlfriend, Reeva Steenkamp.
NPA spokesman Nathi Mncube says the NPA has filed the application for leave to appeal both the conviction and sentence.
Pistorius was convicted of culpable homicide and sentenced to a maximum of 5 years in prison.
The State had sought a conviction on a charge of premeditated murder, which carries a far heavier prison sentence.
Mncube said the appeal on conviction was based on the question of law.
He added that the merits of the NPA's argument in this regard are contained in the papers that were filed with the registrar of the North
Gauteng High Court on Tuesday morning.
Mncube said the matter is now officially sub judice and consequently, the NPA will not be able to discuss the matter publicly until judgment is delivered by the court.
