The High Court sitting at the Palm Ridge Magistrate's Court in Johannesburg has acquitted AB Xuma Primary School scholar patroller, Johannes Molefe, of all the sexual assault and rape charges he faced.
In handing down judgement on Wednesday, Judge Peet Johnson said the court was not satisfied that the state had proved its case beyond reasonable doubt.
Although Johnson said it was understandable that the young girls could not remember the exact dates of when the alleged incidents happened, there had been a comedy of errors in the case on the side of the teachers, police and the Teddy Bear clinic.
Judge Johnson said it was not far-fetched that the children were coached at the Teddy Bear Clinic.
57 year-old Molefe was facing three charges of rape and 11 of sexual assault which he allegedly committed in 2017.
Molefe's sister 72-year-old Mitta Buthelezi said she was happy that the case was over adding that it had affected the family.
She said there were deaths in their family that Molefe missed because he was incarcerated.
The organisation, Women & Men Against Child Abuse said in a statement that it was extremely upset at the judgement.
It said the 54 children in question and their families had been failed by the gross incompetence of not just one, but various components of the state. - ANA
