Oscar Pistorius has launched a legal fight back against the State's attempt to see him convicted of murder.
ENCA reports that the blade runners lawyers are seeking leave to challenge Judge Masipa's decision to give the State right to appeal his culpable homicide conviction.
Pistorius is serving five years in prison for the shooting death of his girlfriend Reeva Steenkamp on Valentine Day two years ago.
His lawyers will appeal on the basis that the State's appeal relies on fact, not law.
They want the right to argue that the State cannot appeal his culpable homicide conviction, as he wasn't acquitted of all charges relating to Reeva's death.
ENCA says Pistorius' lawyers will argue the leave to appeal application next month in the South Gauteng High Court.
